MSME Development (Amendment) Act, 2026 Notified — A Major Overhaul for Delayed Payments & Ease of Doing Business

The Micro, Small and Medium Enterprises Development (Amendment) Act, 2026 (No. 16 of 2026) received Presidential assent on 13th August, 2026 and has been published in the Gazette. This is one of the most significant reforms to the MSMED Act, 2006 in recent years.


Key Highlights:

🔹 New "Development Commissioner" role — designated as the administrative head under the Ministry of MSME, replacing the earlier "Joint Secretary" reference in the Advisory Committee.

🔹 Mandatory TReDS Routing (New Sec. 15A) — All Central PSEs (and notified entities) must now route settlement of MSME invoices through RBI-authorised Trade Receivables Discounting System platforms. State PSEs may be similarly notified by State Governments.

🔹 Faster Dispute Resolution — Mediation before MSEFC must conclude within 90 days of first appearance; arbitral awards within 90 days of completion of pleadings. Appeals under Sec. 18 to be disposed within 60 days.

🔹 Stronger Enforcement (New Sec. 18A) — Mediated settlements/arbitral awards recoverable as arrears of land revenue and recognized as valid debt under IBC, 2016.

🔹 Section 19 Tightened — Any application to set aside an award now requires mandatory pre-deposit of 75% of the awarded amount (earlier discretionary practice varied).

🔹 New Penalty & Adjudication Regime (Sec. 27/27A) — Structured penalties for false MSME registration and buyer non-compliance, with Development Commissioner as Adjudicating Officer and a defined appellate mechanism.


My Viewpoint:

🔹This amendment signals a clear legislative intent — tightening the delayed payment ecosystem for MSMEs through mandatory TReDS integration and time-bound dispute resolution, while simultaneously introducing accountability via a structured penalty and adjudication framework. Corporates, especially large buyers and PSEs, must urgently review their payment/reconciliation processes and compliance calendars.
